Special Board Meeting

August 16, 2023, immediately following the Public Hearing the begins at 7:00pm in the Clover Town Hall (Herbster Gym) Meeting Room/perhaps Town Hall (Historic Gymnasium, depending on attendee numbers).

 

The public is invited to attend, you may walk at any time even though the door is closed—for heat conservation–, you will need to sign for the record.  This meeting is for Board Members only to discuss Agenda Items.

  • Ordinance #20230816, Ordinance to Adopt the Town of Clover Comprehensive Plan 2023-2043—Steele (please see Note #1 below and packets for Ordinance #20230816 and Plan Commission Resolution #20230627, Recommending Adoption of the Town of Clover 2023-2043 Comprehensive Plan)
  • HVFD Bylaws from either August 9, 2009 or the original ones (January 14, 1993)—Steele (Please see Note #2 below and the packets for the two (2) sets of Bylaws (Aug 9,2009) or the original ones (January 14, 1993)
  • Resolution #20230816-1 or #20230816-2 History and Organization of the Herbster Volunteer Fire Department (please see Note #3 below and packets for Resolution #20230816-1 or #20230816-2)

NOTES

Note #1, the Town is required to hold a Public Hearing on the Town of Clover Comprehensive Plan.  There are three (3) notebooks on the shelf just to the north (left) of the meeting room door as you enter the meeting room.  These notebooks contain the Comprehensive Plan for 2023-2043, history of development of the plan, and analysis and statistics from the Survey sent to all property owners.  The Historic Gymnasium is open 24 hours/day seven (7) days per week.  You are encouraged to familiarize yourselves with these documents prior to the Public Hearing and this Special Board Meeting.  The Town Planning Commission via Resolution #20230627 recommends the adoption of the Town of Clover Comprehensive Plan 2023-2043 as the Town of Clover’s comprehensive plan under §66.100(4); and recommends that the Board adopt an ordinance, which will constitute its adoption of the Town of Clover Comprehensive Plan 2023-2043 as the Town of Clover’s comprehensive plan.

Note #2, HVFD Bylaws were revised at the August 2009 HVFD Meeting.  Tim Nicoletti was present at that meeting and attests that the vote of the membership was unanimous.  Steele searched the Board Meeting minutes from August 2009 thru December of that year and did not find the HVFD Bylaws being acted on during this time frame.  The Original Bylaws require that a super majority of both the HVFD members and the Town Board is needed to approve any Bylaws.  We can find no evidence that the original HVFD Bylaws (2097?) were acted on by the Town Board, thus if these are the Bylaws that are desired, action on these by the Board with a supermajority vote is needed also.  We are not sure if the HVFD membership approved the original Bylaws with a supermajority.

Note #3, Resolution #20230816-1 if August HVFD By Laws approved by a super majority or #20230816-2 if the original HVFD By Laws approved by a super majority of the BoardThis resolution is required in order to reup SAMS for the Herbster Volunteer Fire Department in order to receive the 2% Fire Dues from the state and any grants from either the State or Federal Government.  Documentation supporting the Resolution will accompany the Resolution that will be submitted to the proper authorities for reupping SSMS.
