Ordinance #20130814-2 for Use of the Historic Herbster Gymnasium (The Gym)

Whereas the Herbster Historic Gymnasium is an underutilized space

Whereas the taxpayers of the Town of Clover are spending significant tax dollars to maintain this space

Whereas increased use of this space could bring benefits to the taxpayers of the Town in terms of health, education, recreation, meeting and event needs, fostering a sense of community and outreach to the greater community

This Ordinance and the associated procedures and forms are designed to facilitate the benefits outlined above both by residents/taxpayers and friends of the Town of Clover. Such things as exercise (individual and group), games involving physical activity, table games, educational activities (including group webinars), movies, stage plays, meetings and events are envisioned.

II. Policies for use of the Historic Herbster Gymnasium (gym)

1. There is no charge for use of the Gym if no fee is charged for participation except for events (see Events Form for details). Should there be a fee for participation in an activity other than events, then a modest fee will be charged for such use. See the Town Clerk if a fee is being charged for participation in an activity. Exceptions can be made for such things as health screening and immunization clinics.
2. Children under the age of 18 must be accompanied by an adult.
3. The use of any tobacco product is prohibited in and around the gym
4. Only non-glass bottles containing water or soft drinks are allowed in the gym. Alcoholic beverages are not allowed in the gym without clearance by the Town Board.
5. Skateboards, roller-skates, rollerblades, scooters (except for persons with disabilities using scooters for mobility) and other similar devices are not allowed in the gym
6. Physical activities that place the windows and/or light fixtures at risk, i.e. basket ball, volley ball and the like are prohibited at this time as the windows and light fixtures are not protected from hits by the ball.
7. Pets, with the exception of service animals, are not allowed except by clearance by the Town Board or during pet health screening and immunization clinics
8. Disorderly conduct, abuse of the facility, equipment or disregard for gym policies will result in user liability for any damages to the facility or equipment and potential suspension or disbarment from the facility.
9. Non-marking athletic shoes must be worn when engaging in physical activities
10. All players participating in physically active activities must sign the Hold Harmless policy the first time they engage in a given activity. This paperwork will be kept on record.

II. Procedures for use of the Historic Herbster Gymnasium (The Gym)

1. The gym will be open between the hours of 8:00am and 5:00pm daily and by special arrangement at other times.
2. All activities at the gym will be on a first come first serve basis. If others come to join in an activity it is customary to allow them to enter into the activity where appropriate
3. The gym court, stage area or meeting room can be reserved by writing the activity and group on the calendar in the lobby. Should the group decide not to use the gym, please erase or mark out that planned activity so some other group may use that particular gym space at that time.
4. When the activity is completed return any equipment or furniture the proper place including storage areas and leave the space clean and as you found it.

Section III. Effective Date

            This ordinance is effective on publication or posting. The town clerk shall properly post or publish this ordinance, as required under s. 60.80, Wis. Stats.

Hold Harmless Agreement

For Participating in Physically Active Activities

I, ______________________________(print name), understand that participation in physically active activities in the Herbster Historic Gymnasium is voluntary and that no fee has been charged. I agree that participation in physically active activities is undertaken at my own risk and that the Town of Clover will not be liable for any claims, injuries, damages of whatever nature are incurred by me or members of my organization due to the negligence of myself, members of my organization, or the negligence of third parties. On behalf of myself (and/or my children) I expressly forever release and discharge the Town of Clover, its agents or employees, from any claims, injuries, or damages.
